一、查公立各級學校專任教師兼職處理原則第 3 點第 1 項規定：「教師兼職機關（構）之範圍如下：（一）政府機關（構）、公立學校及已立案之私立學校。…。」第 4 點第 1 項規定：「教師至前點所定兼職機關（構）兼任之職務，以與教學或研究專長領域相關者為限，…。」第 5 點第 1 項規定：「教師兼任職務以執行經常性業務為主者，其兼職時數每週合計不得超過八小時。」及第 8 點規定：「教師兼職不得影響本職工作，且須符合校內基本授課時數及工作要求，並事先以書面報經學校核准，於期滿續兼或兼職職務異動時，應重行申請。」
二、基於教師負有輔導學生，導引其適性發展，並培養其健全人格之責，復考量其中又以中小學教師居舉足輕重之關鍵性角色，為免公立中小學專任教師兼任研究助理職務影響教學本職工作及學生受教權益，爰公立中小學專任教師尚不宜兼任研究助理。
