有關勞動部 104 年 11 月 26 日函略以，民法第 1123 條所定之家屬或視為家屬者，為性別工作平等法（以下簡稱性平法）第 20 條所稱家庭照顧假之「家庭成員」，又同法施行細則第 13 條規定，雇主對受僱者申請家庭照顧假，必要時得請其提供相關證明文件。請假規則第 3 條第 1 項第 1 款所定家庭照顧假，係配合上開性平法規定予以訂定，是有關公務人員請家庭照顧假之家庭成員範疇，請依上開勞動部函規定辦理。
