查「性別工作平等法」第 14 條規定略以，女性受僱者因生理日致工作有困難者，每月得請生理假 1 日。復查「性別工作平等法施行細則」第 13 條規定，受僱者依本法第 15 條至第 20 條規定為申請或請求者，必要時雇主得要求其提出相關證明文件。再查勞動部 105 年 2 月 3 日勞動條 4 字第 1040132621 號函規定略以，自 103 年 1 月 16 日「性別工作平等法施行細則」第 13 條規定修正後，受僱者提出生理假申請時，無需提出證明文件；原行政院人事行政局 92 年 4 月 25 日局 2 考字第 0920053614 號書函與旨揭規不合者，自 107 年 4 月 30 日停止適用。
