依現行勞動基準法（以下簡稱勞基法）及其施行細則規定， 9 月 28 日教師節為勞工應放假日（俗稱國定假日）之一，因此，幼兒園依勞基法進用之人員，教師節應依法放假一天。惟查依紀念日及節日實施辦法第 2 條、第 3 條及第 5 條規定，部分國定假日教師並未放假(如： 9 月 28 日教師節、 5 月 1 日勞動節等）。如教師子女就讀之幼兒園於國定假日停課，教師確有親自照顧子女之需求，經敘明親自照顧之必要性，得依性別工作平等法及教師請假規則之相關規定申請核給家庭照顧假。
